13-year-old charged as adult in attempted homicide | News
A 13-year-old boy was charged as an adult in Dane County Circuit Court on Tuesday in the stabbing of his older brother.
Elijah Canada is charged with attempted first-degree intentional homicide after a "play fight" with his 21-year-old brother, Alex, turned bad.
Police said the incident happened Saturday night at an apartment in the 1700 block of Fordem Avenue.
Court documents indicate the two brothers started fighting after the older brother told Elijah he looked "gay" because of a necklace he was wearing.
The fight escalated when Elijah grabbed a knife and his brother said, "I dare you to stab me. You're not going to do nothing," according to court documents.
Court documents said a witness told police that Elijah picked up a knife from the kitchen table, walked up to Alex and stabbed him in the chest.
Alex was transported to a local hospital with a life-threatening injury and underwent surgery over the weekend. Police said the victim is in the Intensive Care Unit and is expected to live.
"It seems to be only sheer luck that his brother did not die," said Dane County Circuit Court Commissioner Todd Meurer.
The defense argued in court that despite how serious the crime is, Elijah is still just a child and he poses no risk to the community.
"I believe the community can be protected by a signature bond, and, if required, his parents are more than willing to co-sign a signature bond. I believe the court should set a signature bond in this case," said Patrick Schilling, defense attorney.
"Weighing all of that out, I am going to set cash bail, and I'm going to set it at $20,000, which is lower than what might be set for an attempted first-degree intentional homicide," Meurer said.
In adult court, Elijah faces upwards of 60 years in prison if convicted on the charge. He is due back in court on July 17.
Alex remains in fair condition at the hospital. According to court documents, the knife severed a major artery, and doctors said if he wasn't as close to the hospital as we was he would have likely died.�
